The ruling: Eastern District of Kentucky Court Chief Judge Danny Reeves in an order Thursday said the regulation on Title IX, the federal law that bars sex-based discrimination, is unlawful. He said the rule is “arbitrary and capricious” and violates the spending clause and the First Amendment, among other issues.

The Biden administration’s Title IX rules expanding protections for LGBTQ+ students have been struck down nationwide after a federal judge in Kentucky found that they overstepped the president’s authority.

The decision threw out the administration’s proposed regulations, which prohibited discrimination based on gender identity.

The President’s veto of the JUDGES Act is extremely disappointing," U.S. District Judge Robert J. Conrad Jr., director of the Administrative Office of the United States Courts, said in a statement.

A federal judge in Kentucky vacated the regulations, which bolstered the rights of victims of sexual misconduct and LGBTQ+ students.

The Biden rule, which makes ‘gender identity’ a protected class similar to sex, ‘turns Title IX on its head,’ the judge wrote.
